Hepburn Shire Council has released a statement, expressing full support for its Chief Executive Officer, Bradley Thomas, and Councillor Don Henderson, who have each been served with alleged criminal charges initiated by a private individual.
The Council said the matter is proceeding as a private prosecution, and that it has not involved an investigation, fact‑finding process, or assessment by Victoria Police or any public prosecutorial authority.
The charges have had the automatic effect of standing down Cr Henderson from his role while the matter progresses, in accordance with the Local Government Act.
It is understood that Mr Thomas is not legally required to stand down, and will continue to act in his role.
The Council says it supports a fair process and will uphold any recommendations handed down by the courts.
